Terms and Conditions

1. These are our Terms and Conditions of your booking a charter with AURORA MARINE CHARTERS, and entering into a whole-boat or part of a group charter scenario, you are agreeing to these terms. PLEASE READ THESE TERMS AND CONDITIONS AND THE DISCLAIMER VERY CAREFULLY BEFORE BOOKING YOUR CHARTER AS THEY WILL APPLY TO YOUR CONTRACT WITH US.

 

2. AURORA MARINE CHARTERS give notice that all arrangements made by us are on the condition that we shall not be liable for any death, injury or damage, loss, delay or irregularity which may be caused by persons or conditions out with our control. We accept no responsibility for any losses or additional expense due to delays or changes, in air, road, rail, sea or other services, strikes, war, weather or other causes.


3. Provisional bookings by telephone or e-mail will be held for 21 days pending receipt of the completed Booking Form and deposit. Every person making a booking on behalf of a passenger or group of passengers warrants and confirms that he/she has the authority of that passenger and that each such passenger agrees to be bound by these Terms and Conditions. Type of payment must be elected at the time of booking either by, cheque, credit/debit card or cash. Cheques must be made payable to "Aurora Marine Charters". All passengers are asked to bring payment to the boat – in the case of cash please bring the correct money.

 

4. We reserve the right to alter prices in accordance with any major changes in cost which may occur between the time of the booking and the time of departure but these will be advised to the charterer at least 7 days prior to the charter, with the option for the booking to be cancelled by the charterer.

 

5. The skipper may refuse to carry any passenger or luggage on any charter for any cause relating to the safety of the vessel or any property or other persons on board. In such circumstances the passenger shall not be entitled to any compensation or payment whatsoever except we shall refund to the passenger any fare paid to us in respect of that charter


6. For all Charters, the Charterer shall provide sufficient instructors and/or other competent persons to supervise all activities that may be undertaken as part of the charter.

 

7. If owing to circumstances beyond our control; Weather, Un-serviceability, we cannot provide the vessel/charter booked, we will in the case of date specific charters i.e. Airborne at Eastbourne provide an immediate and full refund. For Scheduled Charters or days out i.e. birthdays, anniversaries; the charterer must make 3 further recorded attempts to re-book with Aurora Marine Charters. If after these attempts for what ever reason the charter remains un-taken a full refund will be made. However if three recorded attempts are not made within the 6 months after the initial attempt no refund will be made, and the passengers shall have no further claim against Aurora marine Charters. Scheduled charters may also be cancelled up to 14 days in advance of the departure date if insufficient bookings have been made.


8. The Charterer, whether an individual, or booking the whole vessel, is responsible for the whole of the fee he/she has undertaken to pay, and must pay the balance at the end of each charter day unless prior arrangements have been made with the company. If for any reason, the Charterer cancels the booking, within 21 days of departure; he/she remains responsible for the whole of the fee. It may be possible for you to transfer your booking to another individual with our prior agreement. Otherwise we will make every effort to resell the accommodation and if able to do so will refund the deposit and any other money paid minus any administration cost and any other expenses incurred.


9. Our vessel carries a full Marine Insurance policy for bodily injury or accident to passengers on board, and covered for a minimum of £5,000,000 in respect of any one incident. Our insurance does not cover passengers who are away from the vessel or its tender whilst engaged in water sports (such as diving, snorkelling, and swimming) or other activities. We do not accept responsibility for loss of or damage to passengers’ equipment, property or valuables whilst onboard or in transit, so please check your own household insurance cover.


10. No unaccompanied children under the age of 16 can be carried. No children under the age of 12 shall be carried unless part of a whole boat charter and then they are the responsibility of their parents/guardians at all times. Please note that rare exceptions have been made and we will be pleased to discuss your request. No animals to be carried unless with permission.


11. No drugs, other unlawful goods or pornographic materials are permitted on board the vessel and the passenger(s) shall free and release the vessel owners/skipper from any liabilities or responsibility arising out of any breach of this condition.


12. In the unlikely event that you have a complaint please report it to us as soon as possible so that we may deal with it promptly and, hopefully, to your satisfaction. Any legal action or proceedings arising out of or connected with this contract shall be governed by the British Laws.


13. We, or a skipper employed by ourselves, reserve the right to vary the charter in any way we consider preferable due to adverse weather or any other conditions. Ultimate decisions regarding the safety of the vessel, its tender, and those on board, rest with the skipper.

 

14. Boat departure times shown will be confirmed at the time of booking. Any reference to ‘Meet time’ should be considered to be ‘Departure time’.  You and all the members of your group must be ready to board the boat at least 15 minutes before the boat departure time. If you and/or any member or members of your party fail to turn up and/or be ready to board by the scheduled departure time the departure time will not be delayed and this will be treated as a late cancellation and you must pay us the total price of the boat trip. You are advised to ring us on 01323 472009 between 7pm and 8pm the day before the boat’s departure to confirm weather conditions are suitable for the trip and to finally confirm the departure time.

 

15. We will keep a record of your personal data provided to us on the booking form. We will use that data for the purpose of complying with our obligations to you and communicating with you from time to time. We will only use the data for those purposes.
